Terms and conditions

As at 18 September 2026 · Version for business customers · Main version (law of England and Wales)

1. Scope

1.1 These terms and conditions govern the use of Piviq OS (the "service"), a software-as-a-service platform for hospitality and living operators (hotels and resorts, serviced apartments, co-living, micro-living, student housing and PBSA), provided by Plan B Global Ltd (the "provider").

1.2 The service is directed exclusively at businesses. Contracts with consumers are not concluded.

1.3 The provider's identity, company number and registered office are stated in the legal notice (Plan B Global Ltd, company number 16727634, 20 Wenlock Road, London N1 7GU, United Kingdom).

2. Subject matter and packages

2.1 The provider offers the service in the packages Starter, Professional, Business and Enterprise. The scope of services results from the service description and the offer. Technical limits (properties, users, active agents, interfaces) are enforced technically.

2.2 Trial: new customers receive a trial with a limited scope of functions. After it ends, access is locked until a paid package is agreed and activated.

2.3 Enterprise: individual agreement (dedicated environment, custom interfaces and modules).

3. Conclusion of contract and term

3.1 The contract is concluded by individual agreement; registration through the setup assistant alone does not establish a paid contract.

3.2 The term and notice period result from the offer. Without a different agreement the contract renews for the respective term unless terminated 30 days before the end of the term.

3.3 Termination must be in writing. The right to terminate for good cause remains unaffected.

4. Prices and payment

4.1 The prices in the offer apply. All amounts are net amounts.

4.2 For services to businesses in the European Union, value added tax may be owed by the recipient under the reverse charge mechanism. For customers in the United Kingdom, VAT is charged under the applicable UK rules.

4.3 Invoices are due within 14 days without deduction. In the event of late payment, access may be suspended after a reminder without effect; data is retained for 30 days and deleted afterwards in accordance with the deletion concept.

5. Customer obligations

5.1 The customer is responsible for the lawfulness of the data it processes in the service, in particular guest, resident, applicant and employee data.

5.2 The customer keeps access credentials confidential and reports misuse without delay.

5.3 The customer does not use the service for unlawful purposes and does not carry out automated mass communication without a legal basis.

5.4 The customer maintains its own backup of data required for its own business continuity, in addition to the provider's backup arrangements.

6. Availability and support

6.1 The provider operates the service with commercial diligence. A specific availability is only promised where expressly agreed as a service level in the offer. Maintenance windows are announced in advance where reasonably possible.

6.2 Support is provided through the channels named in the offer. Support requests are classified by severity; the agreed response times apply only to agreed service levels.

7. Provider obligations

7.1 The provider maintains the service, applies security updates and remediates defects within a reasonable period depending on severity.

7.2 The provider processes personal data only on documented instructions of the customer and in accordance with the data processing agreement.

7.3 The provider notifies the customer without undue delay where a personal data breach affects the customer's data.

8. Liability

8.1 The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law and to the extent of any guarantee assumed.

8.2 For simple negligence the provider is liable only for breach of essential contractual duties, limited to the foreseeable damage typical for the contract. Liability for data loss is limited to the effort that proper data backup by the customer would have required.

8.3 The customer is responsible for backing up the data it processes in the service in its own systems.

9. Data protection

9.1 For personal data processed by the customer in the service, the customer is the controller and the provider is the processor. The separately concluded data processing agreement applies.

9.2 The service is hosted in the European Union. A list of subprocessors is maintained in the data processing agreement.

10. Changes and final provisions

10.1 Changes to these terms are notified to the customer at least four weeks before they take effect. If the customer does not object within that period, the changes are deemed accepted. The customer is separately informed of the right to object.

10.2 The law of England and Wales applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is London, to the extent legally permissible.

10.3 Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
